1. Acceptance of Terms
By accessing or using Repawify ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
By creating an account, uploading content, or purchasing credits, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
2. Description of Service
Repawify is an AI-powered platform that transforms pet photographs into artistic renderings. The Service allows users to upload pet photos, select from a variety of artistic styles, and receive AI-generated artwork based on their original photographs.
The Service includes both free and paid features. Free features include watermarked preview images. Paid features, accessible through credit purchases, include high-definition, watermark-free artwork downloads.
3. User Accounts
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You agree to notify us immediately of any unauthorized access to or use of your account.
We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete, or if we reasonably believe your account has been compromised.
4. Credit Purchases and Payments
Repawify operates on a credit-based system. Credits may be purchased through the Service via our payment processor, Stripe. All prices are listed in US dollars and are subject to change with prior notice.
Credits do not expire and remain in your account until used. Each high-definition creation consumes one credit. Free watermarked previews do not require credits.
Refund requests for unused credits may be submitted within 7 days of purchase. Refunds are processed to the original payment method. Credits that have been used are non-refundable. We reserve the right to deny refund requests that we reasonably believe are abusive or fraudulent.
5. User Content
You retain ownership of any photographs you upload to the Service ("User Content"). By uploading User Content, you grant Repawify a non-exclusive, worldwide, royalty-free license to use, process, and store your User Content solely for the purpose of providing the Service to you.
You represent and warrant that you own or have the necessary rights to upload the User Content, and that the User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
You are solely responsible for your User Content. We do not endorse or guarantee the accuracy or reliability of any User Content posted through the Service.
6. AI-Generated Content
AI-generated artwork created through the Service ("Generated Content") is produced using third-party AI models. While we strive for high-quality results, we cannot guarantee specific outcomes, and results may vary.
Upon purchasing credits and unlocking the HD version of Generated Content, you receive a non-exclusive license to use, share, reproduce, and display that Generated Content for personal and commercial purposes, subject to applicable laws.
You acknowledge that AI-generated content may occasionally produce unexpected or undesirable results. Repawify is not liable for any Generated Content that does not meet your expectations.
7. Intellectual Property
The Service, including its original content, features, and functionality (excluding User Content and Generated Content), is and will remain the exclusive property of Repawify and its licensors. The Service is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Repawify. Nothing in these Terms grants you any right to use the Repawify name, logo, or other trademarks.
8. Prohibited Uses
You agree not to use the Service to:
- Upload content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Upload content that infringes any patent, trademark, copyright, or other proprietary rights of any party
- Upload images of humans or content that does not depict animals or pets
- Attempt to gain unauthorized access to the Service, other accounts, or computer systems
- Use the Service for any illegal purpose or in violation of any local, state, national, or international law
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use automated means (bots, scrapers, etc.) to access the Service without our express written permission
- Resell, redistribute, or sublicense access to the Service or credits
9. Limitation of Liability
To the maximum extent permitted by applicable law, Repawify and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
In no event shall our total liability to you for all claims exceed the amount you have paid to Repawify in the twelve (12) months preceding the event giving rise to the liability.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us at support@repawify.com.
All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to the new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service.
